Terms and Conditions of the Online Store

These Terms and Conditions define the rules of using the online store quintselection (hereinafter referred to as "quint"), available at www.quintselection.com, operated by Motorise Eryk Popowski, headquartered at 05-120 Legionowo, ul. Wiślana 10, NIP: 5361982139, REGON: 529454243, hereinafter referred to as the "Seller".

1. General Provisions
1.1. These Terms and Conditions specify the rules of using the Store, placing orders, executing sales agreements, the rights and obligations of the Parties, as well as the rules for complaints and withdrawal from the contract.
1.2. The use of the Store is possible provided that the user’s IT system meets the minimum technical requirements: an internet browser that supports JavaScript and cookies.
1.3. Users are required to use the Store in accordance with the law and principles of social coexistence, in particular not to provide illegal content.

2. Definitions
2.1. Consumer – a natural person making a legal transaction not directly related to their business or professional activity.
2.2. Entrepreneur – a natural person, legal person, or organizational unit conducting business or professional activity, making purchases in the Store as part of that activity.
2.3. Order – a Customer's declaration of intent aimed directly at the conclusion of a sales agreement in the Store, specifying the type and number of Goods.
2.4. Goods – products available in the Store that are the subject of the sales agreement between the Customer and the Seller.

3. Placing Orders
3.1. Orders can be placed via the Store’s website, 24 hours a day, 7 days a week.
3.2. To place an order, the Customer must add the selected Goods to the cart, complete the order form, select the payment and delivery method, and then confirm the order.
3.3. Placing an order is equivalent to concluding a sales agreement between the Customer and the Seller.
3.4. After placing an order, the Customer will receive an email confirming the order and details of the execution.

4. Prices and Payment Methods
4.1. The prices of Goods listed in the Store are gross prices (including VAT) and are expressed in EURO.
4.2. The price of the Goods does not include delivery costs, which are indicated when placing the order.
4.3. The Store offers the following payment methods:​

Online payments: credit card, Rapid Transfer, PayPal, Przelewy 24.
4.4. In the case of prepayment, order processing will begin after the full amount has been credited to the Seller's account.

5. Order Fulfillment and Delivery
5.1. Orders are processed within 3-5 business days from the moment the payment is credited to the Seller’s account or from the moment the order is placed in the case of cash on delivery.
5.2. The Goods are delivered to the address provided by the Customer when placing the order.
5.3. The delivery cost depends on the delivery method chosen by the Customer and is indicated when placing the order.
5.4. The Seller is not responsible for the failure to deliver the Goods or delays in delivery caused by an incorrect or incomplete address provided by the Customer.

6. Right to Withdraw from the Contract
6.1. The Consumer has the right to withdraw from the sales contract without giving any reason within 14 days from the date of receipt of the Goods.
6.2. To exercise the right to withdraw from the contract, the Consumer must inform the Seller of their decision by an unequivocal statement sent by email.
6.3. The Consumer is obliged to return the Goods to the Seller at their own expense no later than 14 days from the date on which they withdrew from the contract.
6.4. The Seller will refund the Consumer all payments received, including delivery costs (except for additional costs resulting from the choice of a delivery method other than the cheapest option offered), immediately, no later than within 14 days from the date of receipt of the withdrawal statement.
6.5. The right to withdraw from the contract does not apply in cases specified in Article 38 of the Consumer Rights Act, including goods made to the Consumer's specifications.

7. Complaints and Warranties
7.1. The Seller is responsible to the Consumer for physical and legal defects of the sold Goods under the terms specified in the Civil Code.
7.2. Complaints can be submitted in writing to the address 05-120 Legionowo, ul. Wiślana 10, or via email at [Email Address].
7.3. The complaint should include a description of the defect of the Goods and proof of purchase invoice, receipt.
7.4. The Seller will consider the complaint within 14 days from the date of its receipt. The Customer will be informed of the decision regarding the complaint by email or phone.

8. Personal Data Protection
8.1. The Administrator of the Customers' personal data is Motorise Eryk Popowski, headquartered at 05-120 Legionowo, ul. Wiślana 10.
8.2. The personal data of Customers are processed solely for the purpose of order processing, customer service, and for marketing purposes, if the Customer consents.
8.3. The Customer has the right to access their data, correct, delete, restrict processing, transfer data, and object to data processing.
8.4. Detailed information regarding the processing of personal data is available in the Privacy Policy on the Website.

9. Final Provisions
9.1. The Seller reserves the right to make changes to the Terms and Conditions. Changes to the Terms and Conditions take effect on the date of their publication on the Website; however, agreements concluded before the change in the Terms and Conditions will be governed by the version valid on the date of the conclusion of the agreement.
9.2. In matters not covered by these Terms and Conditions, the provisions of Polish law, including the Civil Code and the Consumer Rights Act, shall apply.
9.3. Any disputes arising from these Terms and Conditions will be resolved by the competent common court in accordance with the provisions of the Code of Civil Procedure.
9.4. These Terms and Conditions are available on the Store’s Website in a format that allows them to be downloaded, saved, and printed.
